While considering a plea to cancel the bail granted to an accused in the case related to the murder of a young man in Uttarakhand last year, the Supreme Court directed the Investigating Officer to remain personally present on the next date of hearing, along with the case documents and the CCTV footage of the crime.

The case relates to the murder of a youth in Raipur in Dehradun District in November 2024, allegedly by seven persons. The FIR was lodged at the instance of the victim's brother.

In May, the Uttarakhand High Court granted bail to one of the accused, Priyanshu Chauhan. Challenging this order, the brother of the victim approached the Supreme Court.

The petitioner argued that even though Priyanshu Chauhan was not named in the FIR, the CCTV footage collected by the Investigating Officer would indicate that he was one of the assailants who attacked the victim. In this context, the Court directed the IO to appear with the CCTV footage.

The co-accused in the case were stated to be absconding.

Issuing notice to the State and the accused, returnable on August 8, the bench comprising Justice JB Pardiwala and Justice R Mahadevan observed :

"On the next date of hearing, the Investigating Officer shall personally remain present with his papers of his investigation and he should also get the recording of the CCTV footage along with him."

The High Court granted bail to the accused, who was arrested in November 2024, observing that the investigation against him has been completed and that he has no criminal antecedents.

Appearances for the petitioner : Senior Advocate J Sai Deepak, Advocates Surya Kant Vyas, Anukirat Singh Baweja, R. Abhishek, Siddharth Praveen Acharya (AOR)
