The Allahabad High Court recently restrained the Uttar Pradesh Police from making late-night 'domiciliary' visits to a man against whom a history sheet has been opened.
A bench of Justice JJ Munir and Justice Anil Kumar-X referred to the Supreme Court's judgment in the celebrated case of Kharak Singh vs The State Of U. P. & Others, wherein it was held that the police cannot pay domiciliary visits to the homes of history-sheeter et cetera at unearthly hours.
The bench passed the order dealing with a criminal writ plea filed by one Samunder Pandey challenging the opening of a history sheet against him, purportedly based on irrelevant material.
He claimed he was being subjected to police harassment under its garb as cops had been entering the petitioner's home at unearthly hours and taking him to the police station, thereby violating his right to privacy and causing mental distress to him and his family members.
Issuing notice to the respondents, including the State of UP, Commissioner of Police, Prayagraj and the concerned Station House Officer (SHO), the bench restrained the police from paying domiciliary visits in the night at 'unearthly hours'.
The matter is listed for admission on July 11, along with a report regarding the status of pleadings.
