Recently, the Allahabad High Court has held that the directive of the Supreme Court in Anil Rai Vs. State of Bihar, prescribing a maximum 6-month period for the delivery of judgment by a bench, is applicable to the Revenue Courts.

Justice Alok Mathur held, “We see no reason as to why the said pronouncement of the Supreme Court should not be extended even to the revenue courts to decide the title disputes as a substitute to the civil courts.”

Petitioner pleaded that the judgment in revision under Section 333 of U.P.Z.A. & L.R. Act was reserved on 16.2.2025, however, no judgment has been delivered till date. Petitioner approached the High Court seeking a writ of mandamus to the Chairman, Board of Revenue, for rehearing of the revision.

The Court observed that in Anil Rai Vs. State of Bihar, the Apex Court had directed that if judgments reserved are not delivered within 3 months, then an application can be made by the parties for early judgment. However, if six months have passed without a pronouncement of judgment, then parties can move an application before higher authority for re-hearing of the case by a different bench.

This decision has recently been followed by the Apex Court in Ravindra Pratap Shahi Vs State Of U.P.

Accordingly, the Court directed the Board of Revenue to re-hear the matter and conclude the arguments within 2 weeks from the date a certified copy of this order is produced before the court concerned and pass a judgment within 6 weeks thereafter.
