Andhra Pradesh High Court Grants 17-Day Interim Bail To Murder Convict To Appear For LLB Semester Exam
The Andhra Pradesh High Court recently granted 17-day interim bail to a murder convict, who is pursuing a five-year B.Com LL. B course, to enable him to appear for his final semester examinations.
A bench of Justice K Suresh Reddy and Justice V Sujatha passed the order to “meet the ends of justice” as the convict's appeal against his conviction is presently pending before the court.
The interim relief was granted to the appellant (Accused No.2/Murali Jai Ganesh), who was convicted in May last year by the X Additional District and Sessions Judge, Tirupati. Following his conviction, he was taken into custody and is currently serving his sentence in Central Prison, Kadapa.
Before the HC, he moved an application under Section 430(1) of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking his release on an interim bail by suspending the sentence of imprisonment to appear for his X Semester examinations scheduled from June 23 to July 2, 2025, along with viva-voce from June 27 to July 5, 2025 in a law college situated in Tirupathi.
The appellant's counsel apprised the bench that the accused could not appear for the exams in the month of June, 2024, as he languished in jail; however, now this time he wishes to appear for the same. It was also submitted that, except for X Semester, there are no other backlogs to the petitioner.
The State, though opposed to regular bail, did not object to granting bail for a limited period.
After perusing the record, the Court noted that the petitioner was a law student with no pending backlogs except the final semester. Thus, observing that the relief would serve the interest of justice, the Court granted him interim bail from June 21 to July 7, 2025 (both days inclusive).
The interim bail has been granted subject to the appellant executing a personal bond of ₹10,000 with one surety of the like amount to the satisfaction of the Superintendent, Central Prison, Kadapa.
Furthermore, the Court has directed him to surrender before the Superintendent of Central Prison, Kadapa, by 5:00 PM on July 7, 2025, without fail.
