Bombay HC Directs Amazon To Comply With Arbitral Tribunals' Interim Orders, Delist All Victorinox Products Being Sold By Ex-Dealer

The Bombay High Court has directed Amazon Seller Services Pvt. Ltd. to immediately delist all Victorinox-branded products being sold by its former dealer, Gute Reise India Pvt. Ltd., in compliance with an arbitral tribunal's interim order. The Court held that online platforms must act swiftly to enforce tribunal directions.

Justice Somasekhar Sundaresan was hearing an urgent commercial arbitration petition filed by Victorinox India Pvt. Ltd., seeking enforcement of an interim order passed under Section 17 by an arbitral tribunal on July 9, 2025.

The tribunal had restrained Gute Reise from advertising, selling, or representing itself in any manner as an authorised dealer, distributor, or franchisee of Victorinox or its products, whether online or at retail locations.

However, Victorinox approached the High Court alleging that despite this order, listings of its branded products sold by Gute Reise under the seller name “Gava Retail” remained active on Amazon's platform, including during the Amazon Prime Day Sale scheduled for the next day.

“Amazon Seller Services Private Limited shall immediately take down and delist all listings of Victorinox-branded products being offered for sale by Gute Reise India Private Limited (under seller name 'Gava Retail') pending conduct of the arbitration proceedings,” the Court directed.

The Court further clarified that Gute Reise would be permitted to use its Amazon account for selling products other than Victorinox's, and Amazon shall not prevent it from engaging in such sales.

Consequently, the court posted the matter for further hearing on July 30, 2025.
