Calcutta HC Grants Anticipatory Bail To Wife Accused Of Abetting Estranged Husband's Suicide After Not Returning To Matrimonial Home
The Calcutta High Court has granted anticipatory bail to a woman who was accused of abetting the suicide of her estranged husband, by her mother-in-law, after the husband hung himself over the wife's refusal to return to the matrimonial home.In granting the plea, Justice Jay Sengupta held: "It will for the Courts to finally decide whether there is any element of abetment of suicide in this case....
The Calcutta High Court has granted anticipatory bail to a woman who was accused of abetting the suicide of her estranged husband, by her mother-in-law, after the husband hung himself over the wife's refusal to return to the matrimonial home.
In granting the plea, Justice Jay Sengupta held: "It will for the Courts to finally decide whether there is any element of abetment of suicide in this case. However, considering the materials available in the case diary and the alleged role attributed to the present petitioner, I do not think that custodial interrogation of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner."
It was submitted by the petitioners that the wife and husband had been living separately since 2022, and the husband had on several occassions, threatened the wife with suicide if she did not return to the matrimonial home. The petitioner-wife had also informed the local authorities of the same.
Petitioners submitted that when the husband committed suicide, the mother-in-law filed an FIR against the wife, accusing her of abetment.
Petitioners further stated that right after lodging the FIR, the complainant sent a copy of the said FIR to the workplace of the accused, which resulted in her suspension from work at a reputed multinational organisation.
It was further submitted that there was a delay in filing the FIR, even after the death of the husband.
Accordingly, in taking into account all the circumstances, the court granted anticipatory bail without going into the merits of the issue.
