The Delhi High Court has recently closed a public interest litigation seeking a time bound scrutiny and raising of defects of fresh matters for listing before the Court.
A division bench comprising of Chief Justice Devendra Kumar Upadhyay and Justice Tushar Rao Gedela said that the issues, if found to be relevant, would be taken up on the administrative side of this Court.
“We do not find it apposite to issue any notice on the judicial side in the present PIL whereby the petitioner seeks to draw attention to certain purported deficiencies and lacunae in the filing/raising of defects, clearing of such defects and the listing of matters thereafter before the Court,” the Bench said.
It added: “In that view of the matter, no further orders are required to be passed and the PIL stands closed.”
The PIL was filed by lawyer Sanjeev Gupta.
He sought a time limit to be imposed for processing of fresh matters for listing, preferably with the time limit for curing defects.
He further prayed that on default for curing defects within prescribed time, the matter be transferred to expired matters in the e-filing portal.
Other prayers in the PIL were:
- That provision in the e-filing software5 to provide details of registration of the Dy Number e-filed with auto email/SMS intimation of the registration to the petitioner.
- That the endeavor to raise defects in consolidated manner instead of raising multiple times. In all matters (not selectively) after obtaining undertaking that “the matter be listed irrespective of defects a petitioner's own risk” this practice of listing be followed uniformly.
Petitioner appeared in person. The High Court was represented by Advocates Samar Kachwaha, Shivangi Nanda, Gaurav Vasisth and Harshwardhan Thakur.
