Delhi High Court Grants Interim Relief To Select City Walk, Restrains Real Estate Developer From Using 'Vardhman Citywalk' Mark
The Delhi High Court has granted interim relief to Select Citywalk Retail Private Limited and restrained a real estate developer from using “Vardhman Citywalk” mark.
Justice Tejas Karia said that Select Citywalk Retail Private Limited has been using the Mark 'CITYWALK' continuously since 2004 with respect to commercial spaces, themed landscapes & outdoor zones, and other entertainment activities and also demonstrated the goodwill and reputation.
The Court said that the use of the impugned mark “Vardhman Citywalk” by Vardhman Amrante Private Limited, the defendant, was prima facie dishonest and nothing but an attempt to ride the goodwill and reputation of Select Citywalk's marks, so as to cause confusion in the market.
“This is a case of triple identity where the Marks are identical, the product category is identical and also the consumer base is identical. The Plaintiffs being the prior user, adopter of the Mark 'CITYWALK' are entitled to protection. The identity in the Impugned Marks is so close to the Plaintiffs' Marks that the two are indistinguishable,” the Court said.
Justice Karia restrained the defendant from using or advertising anything related to real estate development using the impugned marks, including any other mark phonetically, visually, structurally and deceptively similar to Select Citywalk's marks.
The Court issued summons in the suit and directed the defendant to file written statements. It also directed the defendant to file response to the interim injunction application.
The matter will now be heard on January 21, 2026.
