The Delhi High Court on Wednesday (June 25) issued notice to the Municipal Corporation of Delhi on a contempt plea filed in wake of the body's recent demolition drive around a Masjid in city's Mangolpuri area.
Justice Renu Bhatnagar asked the municipal authority to file its response within a week, after Petitioners— Mangolpuri Muhammadi Jama Masjid and Madarsa Anwarul Uloom Welfare Association— alleged that the demolitions were carried out without demarcating the encroached area, in terms of Court's November 2024 direction.
Back then, Justice Sanjeev Narula had directed MCD to indicate to the Petitioners— the area which is encroaching on the public land and that it intends to remove.
Petitioners claim no demarcation report has been furnished to them and that the demolition activity around the property commenced from 12:00 midnight.
Counsel appearing for MCD on the other hand claimed that the encroached area was duly demarcated in the presence of the Petitioners and the same was indicated in the presence of police officials and revenue authorities.
He further submitted that the demolition drive was undertaken only after such demarcation and affixation of requisition notice.
The counsel further undertook to file a complete report in the matter, alongwith relevant photographs.
Petitioners however denied being apprised of any such activity and sought contempt action against the body.
In light of the above, the Court ordered, “Issue notice. Let reply be filed within a period of one week.”
The matter is now listed on July 09.
