The Delhi High Court on Tuesday ordered take down of allegedly defamatory YouTube videos against financial educator and entrepreneur Pushkar Raj Thakur.

Justice Jyoti Singh passed the ex parte ad interim injunction against YouTube channel “DeClutter” in the defamation suit filed by Thakur.

The Court directed the defendant YouTube channel to take down four videos against Thakur which as per the latter were defamatory and harming his reputation.

The Court further directed the defendant not to post any other identical or similar video till the next date of hearing.

During the hearing, senior counsel appearing for Thakur submitted that the defendant was calling Thakur a scamster and fraudster in the videos which cannot be permitted.

He submitted that Thakur is a highly acclaimed financial educator and entrepreneur and has a 15 Million subscribers on YouTube and has great audience on other social media platforms.

Thakur alleged that the defendant YouTube channel launched a defamation campaign against him and made many videos, four of which were challenged in the suit.

It was submitted that the defendant was making baseless allegations and defamatory insinuations against Thakur in the impugned videos.

Issuing summons in the suit and notice in the interim injunction application, the Court observed that prima facie balance of convinience was in favour of Thakur.

The Court ordered that if the defendant does not take any action of removing the videos within two days, Thakur will write to Google to take appropriate action to take down the impugned videos within 48 hours.

The counsel appearing for Google said that if the defendant does not take down the videos, the same will be done by Google.

The matter is now listed before the Joint Registrar on September 03 and before Court on October 14.
