The Delhi High Court on Friday quashed an FIR registered against an employer over allegations of sexually harassing and stalking a female employee, while asking him to do community service at a government hospital in the national capital every Sunday for the next six months.
Justice Ravinder Dudeja quash the FIR registered by the woman after the parties entered into a compromise in July and amicably settled the matter.
The FIR was registered in 2022 for the offences under Section 354(A) (sexual harassment), 354(D) (stalking) and 509 (insulting modesty of a woman) of Indian Penal Code, 1860.
It was alleged that during the employment, the accused employer persistently sexually harassed, stalked and humiliated the woman through obscene remarks, unwelcome physical contact, and social media stalking and later threatened her to withdraw the complaint.
The woman confirmed to the Court that the matter was amicably settled with the employer without any force, fear, coercion and that she had no objection if the FIR was quashed.
The Court allowed the employer's plea seeking quashing of the case, observing that since the parties had put a quietus to the dispute, no useful purpose will be served in continuing with the FIR.
“…the FIR…and all the other consequential proceeding emanating therefrom is hereby quashed subject to condition that petitioner shall perform community service at Lok Nayak Jai Prakash Narayan Hospital, Delhi on every Sunday for the next six months,” the Court said.
It added that the man shall appear before the Medical Superintendent of the LNJP Hospital on the coming Sunday, who shall assign him community service work.
