Delhi's popular restaurant chain has moved the Delhi High Court against a Telangana-based hotel group alleging trademark infringement over the use of the name 'Swagath'.

Justice Amit Bansal issued notices on both the restaurant's suit and interim injunction application, as well as the Rectification Petition seeking cancellation of the hotel group's trademark.

M/s Swagath runs hotels on a franchise basis in New Delhi and adjoining areas.

M/s. Hotel Swagath claims to be operating since 1991 across Telangana and currently operates 11 hotels under the disputed name. It also claims to have previously operated a hotel under the name Swagath in Dubai for 3 years.

The Court has issued summons in the suit and has asked the Defendant-Hotel to file its written statement and reply to the application for interim relief within 30 days.

The Court also issued notice on the rectification petition and granted six weeks to file a response.

Both the matters are now listed on 27th August.
