Delhi High Court Quashes FIR Between Neighbours, Asks Accused To Hold Bhandara For Children During Navratra & Diwali

While quashing an FIR between neighbours over a fight, the Delhi High Court has asked the accused parties to hold “bhandara” for poor children on two occasions- Navratra and Diwali.

Justice Anish Dayal passed the order after the husband and wife, accused in the FIR, undertook to organize bhandara for atleast 50 poor children of the area, once during Navratra period and second time during Diwali.

The Court quashed the FIR filed by a woman against her neighbours- husband and wife, for the offence under Sections 324, 506 and 34 of the Indian Penal Code, 1860. This was after the parties entered into a settlement with each other.

The complainant, who was accompanied by her husband, told Court that she had no objection to the quashing of the FIR, considering that the accused were neighbours and the issues between them were resolved.

As the petitioners undertook to do the social service, the Court directed them to file a report, along with photographs, and that a copy of the same be also given to the concerned IO.

“Subject to this undertaking being complied with, the said FIR stands quashed,” the Court said, while directing the parties to abide by the settlement terms.

“Considering the above settlement between the parties and the chances of conviction of the petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer,” the Court said.
