The Delhi High Court has closed a trademark infringement suit filed by Nestlé S.A., the parent company which manufactures “Maggi”, after it entered into a settlement with a company manufacturing utensils under the mark “Maggisun.”

Justice Tejas Karia decreed the suit as the defendant, Shankeshwar Utensils & Appliances Private Limited, undertook that it will not manufacture or sale pressure cookers or any other goods under the trade mark “Maggisun” or any other trade mark identical to Nestle's trademark “Maggi.”

The suit was filed in 2018 by Societe Des Produits Nestle SA, the official corporate name of the Nestlé company, a global food and beverage giant that acquired the Maggi brand in 1947.

As per the settlement agreement, the Defendant company acknowledged Nestle to be the proprietor of the trademark MAGGI and further acknowledged the validity of all its trademark registrations.

The defendant further undertook not to advertise MAGGISUN, MAGGI or any other similar trademark on any media including print, electronic, social media, or on e- commerce platforms in any manner in future.

Further, the defendant said that it will destroy all the pressure cookers and other goods containing the trademark MAGGISUN, MAGGI or any other similar mark. It was also undertaken that it will cancel the trademark for “Maggisun.”

On this, Nestle's counsel said that remaining prayers in the suit will not be pressed if the suit is decreed in terms of the Settlement arrived at between the Parties.

“The Suit is decreed in terms of the Settlement arrived at between the Parties as recorded above. Let the Decree Sheet be drawn up accordingly. The Parties are directed to be bound by the terms of the Settlement,” the Court said.
