Indian multinational eyewear company Lenskart recently admitted to its mistake in using Tata owned eyewear brand Titan's trademarks on its website and in meta tags.
Titan Company Limited had sued Peyush Bansal's Lenskart for infringement of its trademarks Titan, Titan Eye+ and Fastrack.
The company claimed that its registered marks are used on Lenskart's website and also as meta tags to the source code of the said website.
For context, meta tags are part of HTML which provide metadata about a webpage.
Counsel appearing for Lenskart on advance notice admitted the occurrence of Titan's trademarks on its website and as metatags, attributing it to an 'inadvertent mistake'.
He submitted that Lenskart does not intend to infringe Titan's trademarks and has already taken remedial steps to remove all infringing references.
The counsel further submitted that Lenskart is willing to take down any other such references/ listings, if pointed out by Titan in the future.
In view thereof, the Court disposed of the matter. It ordered, “Binding the defendants to the aforesaid statement, the suit is decreed.”
