The Kerala High Court today impleaded the Bar Council of India in a writ petition seeking reservation under the transgender category for admissions to integrated Five year LL.B courses in Government Law Colleges.
This comes after the State informed that its proposal to create two additional seats for the transgender category is pending approval of the BCI.
The Petitioner, a law aspirant, particularly seeks a direction to GLC Kozhikode, denied admission despite securing qualifying marks in the Kerala Law Entrance Examination.
The Counsel for the petitioner submitted that a seat may be kept open for transgender students, stating that there is already a seat for transgender students in other streams in government colleges.
Justice N Nagaresh however orally observed,
“...the government has taken a decision to create two seats for transgender persons, that will be additional two seats. They have applied for the Bar Council of India for approval…Those are two additional seats going to be sanctioned, it need not be kept open...”
According to Petitioner, she appeared and secured the qualifying marks in the Kerala Law Entrance Examination that was necessary to be included in the rank list. However, she was not given admission in the college under the transgender category.
The plea further seeks a direction to the government to implement reservation for transgender persons in admissions to all Government Law Colleges and other educational institutions under its control.
The plea states that the act of the law college in not providing a separate category/reservation slot for transgender candidates in its allotment list was stated as a violation of the petitioner's fundamental rights under Articles 14, 15, 19, and 21 of the Constitution of India.
