The Kerala High Court has declined the plea for emergency leave preferred by the wife of Sijith @ Annan Sijith, who is presently undergoing life imprisonment in the T.P. Chandrasekharan murder case.
T P Chandrasekharan, who was a member of the Communist Party of India, Marxist [CPI (M)], formed a new political party called the Revolutionary Marxist Party (RMP). To wreck vengeance for the loss of the CPI (M) candidate at the Vatakara constituency in the Lok Sabha election, he was hacked to death on a public road on May 4, 2012.
The petitioner had sought emergency leave for a period of one week so that Sijith could attend the 'choroonu' (first rice feeding) ceremony of his child.
Justice P.V. Kunhikrishnan noted that Sijith was already granted emergency leave for 10 days at the time of delivery of the child, around 6 months back.
The learned judge was of the opinion that paroles can be granted only in extraordinary situations and declined parole for the present ceremony.
The Court observed, "I am of the considered opinion that a life convict is entitled to parole only in extraordinary situations, and that also as per the law in force. Admittedly, the convict was given parole in connection with the delivery of the petitioner. Thereafter, for all ceremonies after the delivery, this Court cannot grant parole to the convict especially because the convict is an accused in a murder case, and one court found that he is guilty."
Thus, the writ petition was dismissed.
