The Madhya Pradesh High Court has issued notice to Union and State Government in a PIL concerning violation of privacy of girls residing in Government Senior Tribal Girls hostel and Government Senior Girls SC hostel, Jabalpur.
As per the plea, a government school is being run inside the premises of the girls' hostel.
The Court has also issued notice to Deputy Commissioner and Assistant Commission of Kendriya Vidyalaya Sangathan.
A division bench of Acting Chief Justice Sanjeev Sachdeva and Justice Vinay Saraf observed, “Issue notice. Notice is accepted by the learned counsel appearing for respondents No.1, 2, 5 to 8. Notice shall issue to respondents No.3 and 4, returnable in week commencing 14.07.2025.”
A PIL has been filed by Adivasi Bahujan Adhikar Kalyan, challenging the unjustified action on the part of authorities for using the campus of Government Senior Tribal Girls hostel and Government Senior Girls SC hostel for running classes for Kendriya Vidyalaya, Garha Jabalpur.
The petitioner organization works towards the upliftment of the tribal society, mainly education and financial development of the tribal and scheduled caste community.
The plea states that in the said premises girl students avail their hostel facilities and the entry of male staff and students is restricted. Therefore, running a school in the premises is in violation of Right to Privacy and Right to life with dignity as enshrined under Article 21 of the Constitution of India. The plea alleges that the said hostel premises is being used since 2007.
The plea mentioned that the petitioner organisation had also submitted representations to the respondent authorities raising concerns of the safety of girl students yet no action has been taken. In the written complaint/representation, the petitioner organisation had also raised the grievance that there have been cases of harassment in the hostel premises and since there are limited number of rooms in the hostel due to the school being conducted in it, girl students have to face inconvenience.
The plea further mentions that even after the order of Jabalpur Collector, the said premises has not been vacated.
Therefore, the petitioner organisation prayed before the Court to issue appropriate writ directing the respondent authorities to vacate the girl hostel premises used by Kendriya Vidyalaya Garha, Jabalpur.
The matter is listed in week commencing July 14.
