'Untenable In Law': Punjab & Haryana High Court Imposes Cost On Law Aspirant Seeking Admission After Missing Entrance Test

Calling the plea "untenable in law," the Punjab & Haryana High Court has dismissed with ₹5,000 cost a petition filed by a student seeking admission despite missing the entrance test.

Chief Justice Sheel Nagu and Justice Yashvir Singh Rathod said, "the prayer is untenable in law...by no stretch of imagination that can be granted."

A BA LLB (Hons) aspirant filed a plea seeking admission in Haryana's Chaudhary Ranbir Singh University. It was his case that the entrance test was earlier scheduled on July 02-03, however the same was postponed and the exam was conducted on July 16.

The petitioner claimed he acted in good faith and waited diligently, checking regularly for official updates. The University failed to issue any SMS, email, or notice on its website in a timely manner regarding the new date, thereby depriving the petitioner of a fair opportunity to appear in the entrance test, the plea added.

Hence, he sought consideration of his case for admission or to conduct a separate entrance test for him.

Refuting the claim, counsel appearing for the Haryana Government Addl AG Deepak Balyan submitted that the notification was duly published on the University's website and the petitioner did not appear for the entrance test, hence, admission cannot be granted without appearing in exam.

Considering the submissions, the Court refused to grant any relief as the student failed to appear in the exam and said that the petition deserves to be dismissed with cost for "wasting time of the court."
