Punjab & Haryana High Court Stays Demolition Drive Against Houses, Shops Allegedly Carried Out Without Notice Under NDPS Act
The Punjab and Haryana High Court has stayed a demolition drive targeting houses and shops that was allegedly carried out without prior notice under the Narcotic Drugs and Psychotropic Substances (NDPS) Act.
Chief Justice Sheel Nagu and Justice Sanjiv Berry while listing the matter for November 7, "Till the next date of hearing, status quo in regard to the property in question of the petitioners be maintained."
Fifteen residents of Punjab's Patiala approached High Court, alleging that their residential houses are either being demolished or are under threat of being demolished by the respondent authorities.
It was alleged in the petition that the petitioners are not involved in any offences under the Narcotic Drugs and Psychotropic Substances Act, 1985, and have also made an averment that their houses have not been constructed in violation of any municipal laws.
The plea also stated that the residential houses and shops of the petitioners are being demolished indiscriminately, without any formal notice and the action was justified by the authorities by falsely stating that the petitioners are accused under NDPS Act.
