The Rajasthan High Court on Monday (September 8) stayed a single bench decision which had canceled 2021 Sub-Inspector Recruitments on account of systemic irregularities.

A division bench of Justice Sanjeev Prakash Sharma and Justice Sanjeet Purohit was hearing a batch of appeals against the cancellation of the selection of Sub-inspectors and the entire selection process of 2021, when the division bench observed that some of the important documents relied upon by the single judge were not accompanied by affidavits of the concerned officer. 

The bench noted that one of the reports extensively relied upon by the single judge, was stated to be submitted by Vijay Kumar Singh IPS, holding the post of Additional DGP Anti-Terrorist Squad and Special Operations Group (SOG) and who was the Chairman of the Special Investigation Team (SIT). The SIT report alleged use of several unfair methods including paper leak, cheating during examination, use of dummy candidates, 

"The said report dated 13.08.2024 has admittedly been submitted by the writ petitioners before the High Court without filing of any affidavit by Mr. Vijay Kumar Singh, ADGP, in support of such a report. It has not been received under the R.T.I. Act," the court noted. 

The bench noted that on a specific query to the Senior Counsel appearing for the writ petitioners, as to how this report was handed over to the writ petitioners, there was no specific answer forthcoming. It was also admitted that the SIT report, is not in public domain.

Similarly, a 22.08.2024 letter by the DGP relied upon by the single judge was placed without any supporting affidavit of the concerned signatory to the letter. The Court further mentioned that the Cabinet Ministers' Committee recommendations relied upon were cited based on media reports.

In this background, the Court said:

 “Considering that the issue involves cancellation of a selection process conducted by the Rajasthan Public Service Commission (RPSC) and the reports relied upon have remained unattested and also considering that there are scathing remarks as against the Members of the Public Service Commission based on such unauthentic report, the judgment would be required to be re examined on the entire aspects afresh by us”.

Issuing notice on the appeal bench said:

"List these matters again on 08.10.2025. In the meanwhile and till further orders, effect & operation of the judgment dated 28.08.2025 passed by learned Single Judge in S.B. Civil Writ Petition No.13806/2024 and other connected matters, shall remain stayed till the next date of hearing". 

However, the State was directed to not make any field postings to the selected Sub-Inspectors under the concerned selection process, while allowing their participation in training.

The matter is listed on October 8.
