The Supreme Court to hear today the pleas challenging #ElectionCommission's Special Intensive Revision of electoral rolls in Bihar

On the last date, the Court directed ECI to publish on websites district-wise list of names of 65 lakh voters deleted in the draft rolls (in EPIC-searchable format)

It also ordered ECI to notify to the public that Aadhaar card can be submitted by those deleted from the draft rolls

J Bagchi (to ECI): Please see the suggestion that has been given. The enumeration and submission of documents [were] at a point of time when the understanding may have been that Aadhaar is not a relevant document...and so, if you can include it as a relevant document, it's going to compromise the time taken for verification.

J Kant: Today we are not extending. But you see if there is overwhelming response...then we will consider.

Order: We direct Bihar CEO to issue notice to President/Working President/GS of the political parties. They shall be represented in Court and file their status reports. We clarify -

(i) individual person at their own or with assistance of BLAs are entitled to apply online. Not necessary to submit application in physical form

(ii) BLAs of all political parties are directed to make endeavor that approx. 65 lakh persons not included in the draft rolls are facilitated, except those who are dead or have voluntarily migrated, in submitting their objections by cutoff date of 1 September

(iii) Wherever physical forms are submitted, BLOs are directed to acknowledge receipt. However, such acknowledgment shall not be proof that form is complete in all respect.

Bhushan: They are saying claim has to be made in Form 6 only. They should have simple application form

Order: [...] to issue specific directions to BLAs to assist voters for submission of requisite forms alongwith any of the 11 documents OR Aadhaar card. In order to facilitate the voters, all abovementioned political parties to be impleaded as respondents.

Order: In a separate note, it is explained that following are the recognized political parties in Bihar...details of BLAs appointed by them also mentioned. What we are surprised to see is that 1,60,813 BLAs have so far filed only 2 objections. On the other hand, [...] political parties have submitted that their BLAs are not being permitted to submit objections. To ensure that each voter, besides his/her independent right to apply for inclusion or to submit objection against inclusion of a person...they are also to be facilitated by the 12 parties recognized in Bihar, who are expected to instruct their BLAs to submit the objections.

Order: Note shows that if all recognized political parties assist, each of their BLAs can verify atleast 10 such names per day...since 1.6 lakh BLAs appointed by political parties....16 lakh can be verified in a day...it won't take more than 4-5 days to verify names that have not been included...still 10 days left to submit objections...there are 84,305 claims/objections received directly from electors...

Order: EC has submitted a status report inter alia pointing out that...district presidents of 12 political parties were present and have signed...further stated that recommendation/non-recommendation by BLOs are not relevant, as persons whose enumeration forms were received have been included in the draft rolls...every objection against deletion shall be in form [6]...draft rolls with reasons for the non-inclusion of names were shown by the BLOs...proceedings of meetings were signed by BLAs of the political parties. Online facility is available to any elector to file claims. It is explained that this Court's directions have been complied with.

Pasha: When EPIC number is entered on ECI website, there is no entry on what document that person has supplied...please see the screenshot

Bhushan: There is no record of any document supplied by any voter

Pasha: So they can't deny later that any document was submitted

Adv Fauzia Shakil: only timeline may be extended. most objections have been facilitated by BLAs... EC is not giving acknowledgment receipt physically
