J Kant: Why can't people who are approaching petitioners approach legal services authority?
Bhushan: What they are saying is that our name has been excluded from either the draft roll or final roll...those deleted from draft roll filled form 6, but name has not been found in final roll
J Kant: This can be raised effectively in appeal
Dwivedi: No elector has come forward to say order has not been provided to them
J Kant: Legal Services Authority can help people with obtaining order.
J Kant: Legal services authority can help people in filing appeals
Bhushan: We have brought 20 more affidavits. ECI will say these affidavits are also not
J Bagchi: Our experience with this one affidavit...We are not in the business of enquiring...
Bhushan: ECI has only made an assertion about this affidavit. It's not demonstrated that the affidavit [is false]. These things are happening so quickly.
J Bagchi: You [ADR] should have handed over this document [yesterday]
Bhushan: Your lordships may ask Legal Services Authority to enquire into the affidavit and file a report. His name, address is given. Affidavit was given to me by a responsible person, therefore I handed it over. All things will come out
Dwivedi: Mr Bhushan should file an affidavit as to how this affidavit was filed
J Bagchi: You're a senior counsel, please don't...
Dwivedi: I am sorry.
Dwivedi: ADR should satisfy itself before throwing a document before the court. This is perjury!
J Kant: We thought we will be able to help those who genuinely want...
Dwivedi: Associations are not helping people, only narratives. ADR is saying a lot in affidavit...how do they know how many Muslims etc excluded? I want an order from the Court that those who want to appeal may do so. After 5 days, doors will be closed
J Kant: The person should have disclosed correct information...we also do not appreciate this
Bhushan: Let me show larger picture
Dwivedi: It's not about the person, ADR is forwarding this.
Dwivedi: Look at the stamp paper. Date and time is 8 Sept, when your lordships passed an order...we were directed to publish names of those whose names were not included...we put it on websites, polling stations, etc...he was fully aware his name was not there...political parties, BLAs, etc. were there...but he does not file
J Kant: Now there is a doubt whether there is a person by this name
Dwivedi: The way these papers are being shown to the Court...they have dropped the story that large no. of people were there. They have given us affidavit at 1.30, it's a different story now...they say about persons who wanted to be enrolled for the first time.
Dwivedi: This particular booth polling station is not part 52 but part 63...I have got voter list of part 63...name occurring is of some lady, who is also in final list. He has perhaps under some mistake said...based on January list...he is giving wrong story that he was in draft roll and was deleted.
Hearing begins
Dwivedi: There are 2-3 things...earlier, argument was that large no. of people were there in draft roll but their names disappeared without notice and order copy has not been given...we have enquired...the affidavit given by them is false...this person was not in draft list because he did not submit enumeration form.
