The Supreme Court will hear tomorrow the plea by MLA Irfan Hafiz Lone seeking restoration of statehood to Jammu & Kashmir. 

The bench of CJI BR Gavai and Justice K Vinod Chandran will be hearing the application filed by Lone. 

Notably, a similar application was filed by college teacher Zahoor Ahmed Bhat and activist Khurshaid Ahmad Malik is also listed tomorrow. The application are filed in the disposed of matter "In Re : Article 370 of the Constitution" in which the Supreme Court upheld the abrogation of the special status of Jammu and Kashmir.

In that judgment, the Court did not address the issue of the constitutionality of the Jammu and Kashmir Reorganization Act 2019, which converted J&K into a Union Territory, in view of the assurance given by the Solicitor General that the Statehood will be restored. The Court merely directed, "Restoration of statehood shall take place at the earliest and as soon as possible", without setting any timeline.

The common contention in all the applications is that while the elections for the UT of J&K were concluded on October 8, 2024, to date, the statehood has not been restored. This violates the Court's direction.
