The Supreme Court will hear at 2 PM today the petitions challenging the constitutionality of the Waqf (Amendment) Act 2025 on the aspect of interim order.

Yesterday, the bench comprising Chief Justice of India Sanjiv Khanna, Justice Sanjay Kumar and Justice KV Viswanathan proposed to pass an interim order with three directions : 

1. The properties declared by Courts as Waqfs should not be de-notified as Waqfs, whether they are by waqf-by-user or waqf by deed, while the Court is hearing the matter.

2. The proviso of the Amendment Act, as per which a Waqf property will not be treated as a Waqf while the Collector is conducting an inquiry on whether the property is a Government land, will not be given effect to.

3. All Members of the Waqf Boards and Central Waqf Council must be Muslims, except the ex-officio members.

However, at the request of Solicitor General of India Tushar Mehta and other lawyers appearing for the respondents, the bench posted the matter to today for hearing on interim order.

#BREAKING In challenge to Waqf Amendment Act 2025, Centre makes the following statements to the Supreme Court :

Non-Muslims won't be appointed to Central Waqf Councils and State Waqf Boards.

Waqfs, including waqf-by-user, whether declared by way of notification or registration, will not be de-notified till the next date of hearing.

CJI: the writ petitions challenging the 1995 Waqf Act and amendment in 2013 shall be separately shown in the causelist. It will be open to file a reply.

CJI: liberty is granted to peititoners, as special case, challenging the 2013 Act, to file response and Union and States may file response, including Waqf Boards within 7 days.

#BREAKING: INTERIM ORDER: during course of hearing, SG states that the Union would like to put a response within 7 says. He further says, he assures the court no appponts will be made to the Council and Board under S.9 and 14. Till the next date of hearing, waqf, including waqf by user already registered or declared by way of notification shall neither be denotified or the collector will change. we take the statement on record.
