To make sure that the evolving technology doesn't compromise fairness, privacy and public trust , the Kerala High Court has taken a significant step in this regard . It has introduced a policy titled “Policy Regarding The Use Of Artificial Intelligence (AI) Tools In District Judiciary.” This is the one of the first time when an Indian Court have taken efforts to clearly define the how AI & Generative AI (GenAI) should be used within the judicial system, setting a strong example for others to follow.

    The Kerala Policy: A Foundational Framework For Responsible AI Integration

    The Kerala Policy is built on clear understanding that AI can be powerful and at the same time it carries risks as well . Its core objective is “to establish guidelines for the responsible use of AI tools in judicial work. The objectives are to ensure that AI tools are used only in a responsible manner, solely as an assistive tool, and strictly for specifically allowed purposes.” A central tenet, unequivocally stated, is that “under no circumstances AI tools are used as a substitute for decision-making or legal reasoning.” This principle firmly anchors the policy in the imperative of human oversight and ultimate accountability.

    The scope of policy is deliberately broad , covering “all members of the District Judiciary in Kerala and the employees assisting them in their diverse judicial work,”. It also includes “any interns or law clerks working with the District Judiciary in Kerala.” The policy applies to “all kinds of AI tools, including, but not limited to Generative AI tools, and databases that use AI to provide access to diverse resources including case laws and statutes.” Furthermore, its applicability transcends geographical and device boundaries, applying “without regard to the location and time of the use, and irrespective of whether they are used on personal devices or devices owned by the courts or third-party devices,” ensuring consistent standards of conduct across all judicial activities.

    The Kerala policy defines Artificial Intelligence (AI) as “a technical and scientific field devoted to developing systems that generate outputs such as content, forecasts, recommendations, or decisions based on pre-defined or learned objectives, often mimicking human cognitive processes.” This definition effectively captures the functional outcomes of AI and its cognitive emulation.

    Similarly, Generative AI (GenAI) is specifically defined as "a subset of AI that uses large language models (LLMs) trained on extensive datasets to generate outputs in response to prompts, including, but not limited to, text, speech, and images." The inclusion of concrete examples of GenAI include ChatGPT, Gemini, Copilot, and Deepseek.

Future iterations of the Kerala policy could benefit from incorporating such elements to address the dynamic nature of increasingly sophisticated AI.

    • Scope of Generative Models: While the Kerala policy's GenAI definition is excellent for current applications, the EU AI Act's concept of a 'general-purpose AI model', “an AI model, including its output, that is capable of competently performing a wide range of distinct tasks. It can be integrated into a variety of downstream systems or applications”, suggests a broader scope for generative models that extend beyond mere content generation to multi-task capabilities. As generative AI evolves to perform more diverse and integrated functions within workflows, considering this broader functional definition could ensure the policy remains comprehensive.

    Despite these potential areas for enhancement, the Kerala policy's definitions are highly practical and directly relevant to the current judicial context, particularly its explicit listing of GenAI examples. This pioneering definitional effort provides a robust starting point for AI governance within the Indian judiciary.

    Guiding Principles, Operational Directives, And Implementation Challenges

    Beyond definitional clarity, the Kerala policy establishes stringent guiding principles for AI use. The emphasis on human supervision and non-substitution is paramount: “AI tools shall not be used to arrive at any findings, reliefs, order or judgment under any circumstances, as the responsibility for the content and integrity of the judicial order lies fully with the Judges.” This principle aligns with global consensus, such as the CEPEJ's Ethical Charter on AI, which underscores the indispensable role of human judgment in adjudication.

    A critical aspect addressed is confidentiality and data security. The policy issues a strict warning against unapproved cloud-based AI tools: “Most of the AI tools, including the currently popular GenAI tools such as ChatGPT and Deepseek, are cloud-based technologies wherein any information input given by the users may be accessed or used by the service providers concerned to advance their interests … Submitting information such as facts of the case, personal identifiers, or privileged communications … may result in serious violations of confidentiality. Hence, the use of all cloud-based services should be avoided, except for the approved AI tools.” This rigorous stance, coupled with the concept of “Approved AI Tools,” is vital for protecting sensitive judicial data and litigant privacy.

    The policy also mandates meticulous verification of outputs, acknowledging that “It is a documented fact that most AI Tools produce erroneous, incomplete, or biased results. Hence, even with regard to the use of approved AI tools, extreme caution is advised. Any results generated by approved AI tools, including, but not limited to, legal citations or references, must be meticulously verified by the judicial officers.” This requirement places the ultimate responsibility for accuracy on human users, mitigating risks associated with AI “hallucinations” and biases. The policy further requires that “Courts shall maintain a detailed audit of all instances wherein AI tools are used. The records shall include the tools used and the human verification process adopted,” promoting transparency and accountability.

    Effective implementation of these directives will face several challenges. The “meticulous verification” requirement, while essential, demands significant time and training, potentially offsetting some efficiency gains. The establishment of a robust, transparent, and agile “Approved AI Tools” evaluation process will be crucial to balance security with access to innovation. Furthermore, comprehensive training programs for all judicial personnel and the development of secure technological infrastructure are vital for successful adherence.

This proactive approach will ensure the policy remains robust and relevant, capable of addressing the complexities of future AI advancements while continuing to uphold the sanctity of justice.
