Allahabad HC Directs ADGP, IGP & SSP To Produce 65-Y/O Allegedly In Illegal Detention Facing Custodial Torture Since August 20

The Allahabad High Court has directed the top police officials of Bareilly [the Additional Director General of Police (ADGP), Inspector General of Police (IGP) and the Senior Superintendent of Police (SSP)], to produce a 65-year-old man (Mahmood Beg) before the Court, who, according to his wife, has been in illegal custody since August 20 and is being subjected to custodial torture in connection with an alleged illegal conversion case.
A bench of Justice Salil Kumar Rai and Justice Zafeer Ahmad passed the order on his wife's Habeas corpus plea. In the plea, she has also claimed that the police officials, who belong to the SOG (Special Operations Group), are demanding illegal gratification of Rs. 1 Lakh for her husband's release.
Considering the allegations and the petition's 'importance', the Court directed the Top Police officials to produce the corpus before it on 8 September 2025.
The Senior Superintendent of Police, Bareilly, has also been asked to personally present in the Court on the next date.
Petition Averments
The habeas corpus plea states that on the night of 20 August 2025, around 11:15 PM, 11 persons arrived at the petitioner's residence in three jeeps and forcibly took away the petitioner's husband.
The petition states that when the couple's son protested to this, one of the men pointed a revolver at his chest and threatened to shoot him if he spoke further. The plea avers that the arrival and actions of these persons have been captured in the CCTV footage installed at the petitioner's house.
It is further submitted that Beg, aged about 65 years and suffering from ailments, was illegally detained by police, and thereafter an illegal gratification of Rs. 1,00,000/- was demanded from the family for his safe release.
The plea added that Beg has no criminal antecedents, and yet he has been kept in illegal custody since 20 August 2025, in gross violation of the fundamental rights guaranteed under Article 21 of the Constitution of India.
