Allahabad High Court Raises Concern Over Male Gym Trainers Imparting Coaching To Female Clients Sans Safeguards

A bench of Justice Shekhar Kumar Yadav was hearing an appeal filed by a gym trainer who has been accused of using a caste-based slur against a woman client, pushing her and hurling filthy abuses.

Briefly put, the accused-appellant was booked under the provisions of the SC-ST Act as well as the IPC for the above-mentioned offending acts against a female client.

In her statement recorded under Section 164 CrPC, she also claimed that the appellant had prepared obscene videos of her friend and had been sending such obscene material to the said friend.

Taking into account the allegations levelled against the appellant, the bench, noted that the alleged acts may also attract offences punishable under Sections 354 & 504 IPC.

Against this backdrop, the bench remarked thus:

“It is a matter of serious concern that presently male gym trainers are imparting training to female clients without adequate safeguards to ensure their safety and dignity”.

Furthermore, considering the aforesaid circumstances, the concerned IO was directed to file a personal affidavit indicating:

• Whether the gym operated by the appellant was duly registered under the law.
• Whether the appellant has been arrested in connection with the present case or not ?
• Whether in the gym, trainers are female or not?

The matter will now be heard on September 8.
