    On Tuesday, the Allahabad High Court has stayed the Government notification dated 05.07.2025 by which the State Government has raised the fees of the MBBS course with effect from academic year 2024-25.

    240 MBBS students approached the High Court challenging the legality and validity of the impugned notification dated 05.07.2025 whereby tuition fee of the students of MBBS course was raised w.e.f. the academic session 2024-25 from Rs.11,78,892/- to Rs.14,14,670/- on grounds that the same was arbitrary. It has been pleaded that the notification is contrary to the provision of Section 10 of U.P. Private Professional Educational Institutions (Regulation of Admission and Fixation of Fee) Act, 2006.

    Petitioner also argued that other miscellaneous charges have already been enhanced during this Session and now the tuition fees is being enhanced without any justification, second time in 8 months.

    It has been argued that the fees has been increased pursuant to order of the Lucknow Bench of the High Court where U.P. Unaided Medical and Allied Sciences College Welfare Association and 17 others including the respondent no.3 college had filed a writ petition challenging the applicability of fees structure of academic year 2023-24 to academic year 2024-25. The High Court had ordered the Committee to consider the request of institutions for enhancement of fees in proportion to the rate of inflation.

    Considering the submissions made by the parties, Justice Chandra Dhari Singh directed the parties to file short counter affidavits and directed that the notification dated 05.07.2025 shall be kept in abeyance till the next date of listing.

    The case is directed to be listed on 17.09.2025.
