The Delhi High Court on Wednesday issued notice on a plea filed by Aam Aadmi Party (AAP) Chief Arvind Kejriwal challenging a trial court order upholding the summons issued to him in the money laundering case related to the alleged liquor policy scam.
Justice Ravinder Dudeja sought response of the Enforcement Directorate and directed it to file counter affidavit within six weeks.
The counsel appearing for ED, at the outset, raised preliminary objection on the maintainability of Kejriwal's plea. It was submitted that the plea was a second revision petition filed under the garb of a plea under Section 482 of CrPC, which cannot be allowed.
The Court asked ED's counsel to raise the preliminary objections in the response, while also issuing notice on Kejriwal's second petition challenging a sessions court order passed on December 20, 2024, upholding an order of a magisterial court refusing to transfer his case to another court.
The matter are now listed for hearing on September 10.
In July last year, the Supreme Court granted interim bail to Kejriwal while referring his petition challenging the arrest by ED to a larger bench.
Kejriwal was granted bail by vacation judge Niyay Bindu of Rouse Avenue Courts on June 20, 2024. On ED's challenge, the Delhi High Court stayed the impugned order on June 25, 2024.
Kejriwal was arrested by the Enforcement Directorate (ED) on March 21, 2024. In May last year, he was granted interim bail by the Supreme Court till June 01, 2024 in view of general elections.
