'Deceitful': Delhi High Court Slams Man For Unauthorisedly Filing Plea On Behalf Of NGO, Orders Probe

The Delhi High Court has come down heavily on a man for unauthorisedly filing a writ petition on behalf of a NGO, against an alleged illegal construction in the city's Jamia Nagar area.
The man had apparently misused the letter head of a NGO to file the plea. However, the NGO's head subsequently appeared and apprised the Court that the man is unconnected with the NGO and sought withdrawal of the plea filed in its name.
Counsel appearing for MCD however informed the Court that action against the property in question had already been initiated. Few photos filed before the Court reflected part demolition.
Shocked, Justice Mini Pushkarna observed,
“Clearly when an unauthorized person files a petition of this nature for taking action against unauthorized construction, the said conduct is not only deceitful, but also misuse and abuse of the process of law.”
The bench said that Courts discharge a very critical function of dispensing justice but when such solemn process of the court is misused by parties for their personal and unlawful gains and with ulterior and covert motives, the Courts have to come down heavily on such unscrupulous persons.
“In the present case, filing of a petition by using name of an NGO, when the deponent has no concern with such NGO and has not been authorized by such NGO to file any petition in its name, is a gross misdeed and malpractice, which cannot be condoned or let off in a light manner,” the Court said.
Accordingly, it imposed a cost of Rs. 50,000/- upon Farid Ali, the Petitioner.
The Court also directed the concerned Deputy Commissioner of Police to investigate the matter, and take appropriate action against Ali.
