    The Delhi High Court has granted an ad-interim injunction against actor Ravi Mohan's production house, preventing the use of the trademark 'BRO CODE' for the title of its upcoming Tamil film, following a suit by the makers of the alcoholic beverage 'BROCODE'

    The order comes after Indospirit Beverages Private Limited, a leading alcoholic and non-alcoholic beverage company, alleged that the studio's use of the name would infringe upon its well-known mark and create confusion among consumers.

    Observing that the use of an identical trademark would create confusion and infringe upon the rights of the company, a single bench of Justice Tejas Karia held:

    "In view of the above, a prima facie case is made out by the Plaintiff that the Plaintiff's Mark has been used in an identical manner in the title of the Defendant's film without any authorization from the Plaintiff, which amounts to infringement and is also likely to create confusion in the minds of the consumers of the Plaintiff's product under the Plaintiff's Mark, regarding association of the Defendant's film with the Plaintiff, which is likely to cause irreparable injury to the Plaintiff."

    The dispute arose after Indospirit Beverages, a Delhi-based company founded in 2014 accused Ravi Mohan Studios for adoptiong its flagship trademark 'BROCODE' for an upcoming movie without consent.

    Indospirit has been using the mark since 2015 for its innovative carbonated wine-in-a-pint product and more recently for digital content, including the YouTube series 'BroCode Roast' and the music video 'BroCode: Onam Ulsavam Song', which have collectively garnered millions of views online. Despite repeated emails in September 2025, and a legal notice in October the studio continued to use the mark prompting the present suit.

    In court, Indospirit argued that its mark has significant goodwill and recognition that extends beyond beverages, qualifying it as a well-known mark deserving protection even in unrelated sectors such as film.

    Ravi Mohan Studios countered that Indospirit did not hold a trademark registration in Class 41, which deals with entertainment. It relied on an interim Madras High Court order protecting the studio from alleged groundless infringement threats.

    The court, however, rejected the contention on the ground that a remedy for an action against groundless threats comes to an end once a permanent suit for infringement is filed. Accordingly, holding that the Madras High Court's order does not prevent it from granting relief in the case, the court granted an ad-interim injunction, restraining Ravi Mohan Studios, its directors, employees, agents, and associates from,

    "Using, adopting, reproducing, broadcasting, promoting, publishing, displaying, communicating, selling, offering for sale, or otherwise exploiting the Plaintiff's Mark 'BROCODE' in any manner, directly or indirectly, or any other Mark identical with or deceptively similar to the Plaintiff's Mark 'BROCODE' in connection with the upcoming cinematographic film, its trailer, teaser, poster, social media campaign, or any other related or unrelated content, whether in physical or digital form, amounting to the infringement of the Plaintiff's Mark 'BROCODE'"

    The court further clarified that the studio may continue producing the film as long as the injunction is followed. Summons were issued to the Defendant, and the matter is listed for further hearing on December 23, 2025.
