Delhi High Court Dismisses Another Plea Against Centre's Decision To Revoke Celebi's Security Clearance

The Delhi High Court on Thursday dismissed a plea filed by another plea filed by Turkey based company namely Celebi Ground Handling India Private Limited, challenging the decision of the Central Government's Bureau of Civil Aviation Security (BCAS) revoking its security clearance in the "interest of national security".

Justice Tejas Karia pronounced the verdict and dismissed the petition.

On July 05, a coordinate bench had dismissed the pleas filed by Turkish-based firms namely Celebi Airport Services India Private Limited and Celebi Delhi Cargo Terminal Management India Private Limited, challenging the revocation of their security clearance.

Today, Justice Karia dismissed the plea observing that it was identical to the issues raised in the other petitions and thus, the decision of the single judge squarely covered the issue in hand.

“The petition is accordingly dismissed,” the Court said.

The coordinate bench, while dismissing similar pleas, had observed that while natural justice is an important Constitutional principle however in matters of "security of the realm", natural justice must yield to preserve national security. 

The coordinate bench also said that there were "compelling national security considerations involved", which impelled the Union Government to take action against Celebi.

The Indian government had revoked the security clearance of Celebi and its associated companies on grounds related to national security.
