Expeditiously Decide Plea To Maintain Database Of Complainants Filing Multiple Sexual Offence Cases: High Court To Delhi Police

The Delhi High Court on Wednesday asked the Delhi Police and other authorities to decide expeditiously a plea seeking maintenance of a database of complainants who have filed multiple cases of sexual offences.
A division bench comprising Chief Justice DK Upadhyaya and Justice Tushar Rao Gedela disposed of a PIL filed by one Shonee Kapoor, represented by Advocate Shashi Ranjan Kumar Singh.
During the hearing, Kumar said that apart from maintaining the database, the PIL also sought a direction that the identity cards of the complainants must be taken by the police, and submitted that a similar order to the said effect has been passed by the Punjab and Haryana High Court.
To this, CJ Upadhyaya remarked that “it is their functioning” and that “they know it better how the policing is to be done.”
The counsel referred to a recent report published by Times of India highlighting that the conviction rate of the cases of rape in the national capital is only 4.3%.
To this, the Court remarked:
“Is it a petition or a suggestion? This is their job. They know how policing is to be done more appropriately. How can Court interfere in such matters?”
The counsel informed the Bench that a representation was filed on the issue before the authorities, including the Commissioner of Delhi Police on March 03.
He further informed that as per an RTI reply received on April 17, the representation was under consideration of the senior officials.
Noting that Kapoor has already represented the cause by making a representation to the Delhi Police and other authorities, the Court said:
“Without expressing any merit on the issues raised, the petition is disposed of with the direction to the authorities to take an informed decision on the petitioner's representation with expedition. The petition stands disposed of accordingly.”
