    The Delhi High Court has asked the Armed Forces Tribunal (AFT) to decide a plea filed by various women officers of Judge Advocate General (JAG) Branch of the Indian Army, seeking Permanent Commission.

    The women officers are presently on Short Service Commission Officers.

    A division bench comprising Justice C Hari Shankar and Justice Om Prakash Shukla said that since the officers are in service, they are subject to the provisions of the Army Act, 1950.

    “Section 14 of the Armed Forces Tribunal Act, 2007 renders the cause in this petition amenable to adjudication by the Armed Forces Tribunal,” the Court said.

    Senior Advocate J Sai Deepak appearing for the women officers did not contest the position but requested the Court to direct the AFT to expeditiously decide the matter, in view of urgency.

    The Court said that while it appreciates the urgency of the matter, it was unaware of the pendency of the matters before the AFT.

    Accordingly, the Bench reserved liberty with the petitioners officers to request the AFT to take up the matter on priority basis.

    Observing that it is sanguine that the AFT would treat the petition with the urgency it deserves, the Court ordered:

    “In order to expedite matters, we are not requiring the petitioners to reinstitute the petition before the AFT. We request the Registry of this Court to transmit this petition to the Registry of the AFT which shall thereafter register as an Original Application and list the matter before the appropriate Bench for hearing.”

    The Court directed the parties to appear before the concerned Bench of the AFT on October 10, adding that no adjournment would be sought on the said date.

    “We make it clear that we have not expressed any opinion on the merits of the matter one way or the other. The writ petition is disposed of,” the Court said.
