    The Delhi High Court has directed the New Delhi Municipal Corporation (NDMC) to forthwith stop the unauthorised or illegal construction in city's Sarojini Nagar market.

    Justice Mini Pushkarna sought response of the NDMC on the action taken by it against alleged illegal encroachment by the shopkeepers in the Sarojini Nagar market.

    The Court issued notice on a plea filed by Sarojini Nagar Market Rehari Patri Howkers Vikas Samiti seeking removal of alleged illegal encroachment and construction done by the shopkeepers or in the market.

    A further prayer sought directions on NDMC to take immediate action to stop the alleged misuse of the units, claiming that the same was contrary the layout plan sanctioned by the civic authority.

    The counsel representing NDMC submitted that a survey was being conducted by the authority in furtherance to a redevelopment plan for the Sarojini Nagar Market.

    It was submitted that comprehensive action shall be taken by the NDMC only after the detailed survey is concluded, which was likely to be completed in 10 to 12 weeks.

    “Accordingly, let a fresh affidavit/Status Report be filed by the NDMC. In the affidavit, the NDMC shall specifically indicate as to the extent of encroachment by the various shopkeepers, and the action which is sought to be taken by the NDMC against such encroachments,” the Court said.

    It added: “In case any fresh unauthorized construction/encroachment is being carried out in the market in question, the same shall be stopped by the NDMC forthwith.”

    The matter will now be heard on October 31.
