Urging the Supreme Court to reconsider its decision to transfer Gujarat High Court Judge, Justice Sandeep Bhatt, the Gujarat High Court Advocate Association today had a delegation meeting with CJI BR Gavai and Justice Surya Kant.

The delegation of GHCAA that met the CJI today included GHCAA President Brijesh Trivedi, advocate Hardik Brahmbhatt, senior advocate Asim Pandya, advocates Babubhai Mangukya, advocate Dipen Dave and advocate Bhargav Bhatt.

The representation submitted to the CJI explains that the present concerns over the transfer of Justice Bhatt stem from a row of past developments, including some of his orders passed against the registry.

Urging the Supreme Court collegium to reconsider its decision of transfering Justice Bhatt, the Association highlighted, " In such a backdrop, to transfer a Judge from one High Court to another High Court, looks like a decision, which generate any type of debate amongst the legal fraternity, would look like a stigmatic transfer, having consequential effect of ruining the image of not only the concerned Judge, but the entire Justice Delivery System, which we all cherish with highest respect. We all make continuous efforts, so that the image of Justice Delivery System remain at the highest point and the people do not lose the faith in the justice delivery system."

The Association also suggested the need to have a scheme on regular transfers of all High Court judges at periodic intervals. It explained:

"In fact, if there is a system of regular transfer of all Hon'ble Judges at regular intervals, then no one will be able to see such transfer as a step to transfer any Judge, as if the same is done, when the acts of any Judge is under cloud. Such a decision will advance the cause of Justice and there will be no such issues in future, when regular transfer become part of the condition for this pious Service as a Judge, as all those, who accept the call of duty to serve the system, most of them sacrifice their lucrative practice to serve the institution and therefore, when something like this happen, it sends wrong signal to those, aspiring to serve this pious institution and we may miss such people, who are ready to serve this Institution."
