The Gujarat High Court on Thursday (September 11) asked a litigant challenging the teaser of the upcoming movie 'Jolly LLB 3' to go through the order of the Allahabad High Court–which dismissed a plea for restraining the release of the movie, and thereafter take a call with respect to his plea.
The film starring actors Akshay Kumar and Arshad Warsi is scheduled for release on September 19.
During the hearing in the pre-lunch session, the petitioner who appeared in person submitted before Justice Niral R Mehta that he was challenging the certificates issued by CBFC.
"The locus is to file this petition is only to save and uphold the dignity of this court, because there is some vulgar words in the teaser. Im only challenging certificates of the teaser," the petitioner said.
He added that he had made a representation to the CBFC but there had been no response.
Noting that the representation was filed with the CBFC on August 13 (one day after the release of the teaser), the court then orally told the counsel appearing for the authority to come back in the post lunch session and inform about the date by which the representation of the petitioner will be decided.
When the matter was taken up in the post lunch session the counsel for the respondent submitted that the representation will be decided on or before Tuesday (September 16).
The counsel also handed over the Allahabad High Court's order stating that a plea on a similar issue had been dismissed by the high court.
Earlier this month, the Allahabad High Court had dismissed a writ plea seeking action against the song 'Bhai Vakeel Hai' from the upcoming Bollywood film 'Jolly LLB 3'. It had also rejected the prayer to restrain the movie's release on the grounds that it allegedly defamed the judiciary and legal profession.
To this the petitioner in the present matter however said, "My prayer is for teaser, because teaser is part of the film".
The court thereafter orally told the petitioner, "If you want to take...a call then take. Go through it (Allahabad High Court order). Because now the direction to issue representation is futility".
The court thereafter listed the matter on September 16.
Update: When the matter was heard on September 16, the petitioner sought to withdraw the petition.
The plea was thus disposed of.
