    The Jammu & Kashmir Highcourt has stayed criminal proceedings pending before a trial court in Jammu against two relatives of former Chief Minister Ghulam Nabi Azad.

    A bench of Justice Rajesh Sekhri passed the interim order while hearing a petition challenging the proceedings arising out of a complaint filed by a worker of Aam Aadmi Party and also a director of Hyber Hightech Innovative Engineering and Infrastructure Pvt. Ltd.

    The criminal complaint has been filed against Mubashar Ali and Yawar Ahmed both related to the former Chief Minister. The proceedings are pending before the court of the Sub-Judge (JMIC), Jammu.

    The counsel Appearing on behalf of petitioner submitted that the complainant had hired petitioner's firm, Chenab Enterprises, to provide transport services under a formal work order. In return, a cheque of Rs 43 lakh was issued to petitioner by respondent signed by both directors of the company, including the complainant.

    The counsel further submitted that shortly after two partial payments of Rs 10 lakh each were made from petitioner's account, the complainant filed baseless complaint against the petitioner before the Sub-Judge court, directed J&K Bank to freeze the petitioner's accounts.

    The counsel argued that the above orders were passed without giving notice to the petitioner causing grave injustice. He argued that the freezing of accounts and the initiation of criminal proceedings were intended to deprive petitioner of his legitimate dues.

    The court stayed the proceedings before the trial court and issued notice to the complainant and other respondents.
