    The Karnataka High Court has adjourned a plea filed by Marketing and Revenue head of RCB Nikhil Sosale challenging his arrest by the Bengaluru Police in the early hours of Friday (6th June).

    Though the court prima facie opined that an FIR was enough to make the arrest, noting that the matter involved personal liberty of an individual, the court adjourned the case to Monday.

    Sosale had argued that the arrest was made based on instructions from the Chief Minister and that there was no materials against him. Senior Advocate Sandesh J Chouta and Senior Advocate Nandakumar, appearing for Sosale argued that the arrest was illegal. It was argued that arrest was the domain of the Investigating Officer and no arrest could be made just because a superior instructed to do so.

    The court, however, pointed out that when an FIR had been registered against Sosale, there was no impediment to arresting him.

    Though Sosale's counsel argued that the SHO in charge had been suspended, the court questioned how a policy decision of the State regarding his suspension would affect the FIR. 

    Accordingly, the case was adjourned to Monday, 9th June.
