Karnataka High Court has relaxed the condition imposed on former Lok Sabha MP and Janata Dal (S) leader Prajwal Revanna's mother, Bhavani Revanna, restraining her from entering her native districts of Mysuru and Hassan.
The condition was imposed while granting he anticipatory bail in connection with the Kidnapping case lodged against her, linked to the rape case pending against her son Prajwal.
"IA is allowed. The bail condition is relaxed. Petitioner accused is permitted to enter the district of Mysuru and Hassan. However, Petitioner (A-8) strictly restrained from going anywhere within 500 meters radius of house of victim and other witnesses," the Court ordered today.
It further directed Bhavani to not threaten the victim and the prosecution witnesses. "State government is at liberty to move court for variance or cancellation if there is any defiance of the order," the Court added.
Appearing for Bhavani, senior advocate Sandesh J Chouta had submitted that the condition was imposed when the offences alleged included 364A IPC (kidnapping for ransom) which is punishable with death or life imprisonment. "This order was challenged in SC and it came to be dismissed. For the rest of the offences for which cognizance is taken, the punishment is less than 7 years," he submitted. Chouta added that Bhavani has family roots including "deity in Holeinarsipura".
The prosecution had opposed the application contending that Bhavani Revanna is 'mastermind' behind abduction to prevent complaint against Prajwal Revanna. He argued that though the nature of offence is such that bail should not have been granted but court found it fit to impose the condition to prevent her from entering the districts.
