Two residents of Arattupuzha Gram Panchayat have moved the Kerala High Court, challenging the delimitation process done in their constituency. After the recent delimitation process conducted in the State, the number of wards in the Panchayat has been increased from 18 to 19.
The petitioners claim that seat limitation and the consequent delimitation process are based on incorrect data. They had sought the Court to declare the delimitation process in their panchayat as illegal.
Earlier, a Division Bench of the Court had affirmed the delimitation process conducted by the State and rejected arguments saying that they had used outdated census data to carry out the process.
In the guidelines issued by the Kerala Delimitation Commission, it is given that the population of a constituency has to be calculated by dividing the total population of the Grama Panchayat (as per 2011 by census) by the total number of residential houses in the area at present (as per the Assessment Register) and multiplying it by the residential homes in the constituency.
The petitioner claims that the number of residential homes given in the Assessment register available in the Sanchaya portal is incorrect.
The petitioner claims that the register includes houses that are damaged by sea erosion in which nobody is residing and houses from which people have moved out of and resettled somewhere else after taking the benefit of the resettlement program of the Government. They also claim that there is a duplication of houses in the register. It is also urged that there are even shops, barns and temporary sheds included in the list of houses.
