Kerala High Court Asks Police To File Statement Regarding Investigation Into Kasargod Teen's Death, Says Case Diary Shows Action Was Taken

The Kerala High Court on Tuesday (11th March) directed the Police to file a statement regarding investigation into the disappearance and death of the 15-year old girl child from Kasargod.
While dealing with her mother's plea accusing the Police of inaction in the matter, a Division Bench of Justice Devan Ramachandran and Justice M. B. Snehalatha also orally remarked,
“We cannot find from the CD (Case diary) that they have not taken action, they have taken action. You may have a case that the investigation is not proper. That's not for us to take a call on and we are not going to speak about the investigation.”
However, since the Case Diary cannot be shared with the parent, the Court directed the investigating officer to file a statement detailing the stages of investigation so that the child's parents can also know about how the investigation progressed. The Court indicated that it will proceed to close the petition after that.
The habeas corpus plea was filed over disappearance of the teen on February 11. On the same day, one Pradeep, a 42 year old taxi driver who was known to be close to the child's family, was also found to be missing. The mother had stated in her petition that her daughter was forcefully taken by Pradeep and was detained in his illegal custody. Pradeep was also found dead along with the child. The mother had lodged a complaint with the police about the missing child on 11th February itself.
In her plea, the mother argued that if the police had acted swiftly on her complaint, the death of her child could have been prevented. The Court had then directed the investigating officer to appear and produce the case diary.
Perusing the same it orally remarked that it cannot be said that the Police have not taken any action. The matter is next posted on 18th March.
