MP High Court Issues Notice On PIL Against Alleged Encroachment Of Govt Land Restricting Villagers' Access To Religious Site

The Madhya Pradesh High Court, on Monday (September 22), issued notice on a PIL by the elected Panch of the Gram Panchayat Tilgawa in District Panna, seeking removal of an alleged encroachment of public land claiming that it restrains villagers from accessing a religious site–'Thakur Baba Chabutra'.
A division bench of Chief Justice Sanjeev Sachdeva and Justice Vinay Saraf, in its order, directed;
"Issue Notice. Notice accepted by learned counsel appearing for respondents no 1 and 2. Notice shall be issued to respondent no 3. Returnable after two weeks"
The petitioner had approached the court seeking directions for the 'removal of illegal possession of the private respondent no.3 (Prakash Vishwakarma) from the government land'. It was contended that multiple representations were submitted to the concerned authorities, but no action was taken.
Subsequently, the Tehsildar initiated proceedings under Section 248 of the M.P. Land Revenue Code and passed an order on October 22, 2021, imposing a cost of ₹ 2,000 for the removal of the encroachment. Thereafter, another order was passed on January 13, 2022, which imposed a cost of ₹1,500.
The petitioner claimed that, despite these orders, the private respondent did not comply with the orders till date and that the authorities did not initiate action to ensure compliance.
Therefore, the petitioner in its petition sought directions for the State Government and the Collector of Panna to ensure compliance with the aforementioned orders.
The case is expected to be listed after two weeks.
