MP High Court Grants Anticipatory Bail To Woman Booked In Cheating FIR For Developing 'Unauthorized Colony'

The Madhya Pradesh High Court granted anticipatory bail to a woman accused of developing an unauthorised colony and selling plots in Sagar District without the requisite permissions.
The court directed the applicant to cooperate with the investigating agency and shall also appear on the date and time, as directed by the Investigating Officer. The woman has been booked for cheating (Section 420) IPC and illegal colonization (Section 292-c) of the Municipal Corporation Act.
Counsel for the applicant submitted that the Municipal Corporation Authority lodged a false report alleging that the petitioner without taking permission developed an unauthorized colony. The counsel said that the applicant is a lady and undertakes to cooperate with the investigation.
Counsel for the state argued that the applicant had developed a colony and sold plots without obtaining development permission, land diversions or sanction from the competent authority. It was further argued that, being a colonizer, she was not entitled to bail.
Justice Devnarayan Mishra said:
"Looking to the factual aspect and the applicant is a woman, the anticipatory bail application is allowed... It is directed that in the event of arrest, the applicant shall be Rs.50,000/- enlarged on bail on furnishing a personal bond in a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one surety in the like amount to the (Rupees Fifty Thousand Only) satisfaction of the Arresting Officer for her appearance before him during the course of investigation or before the trial Court concerned during trial, as the case may be".
The case was disposed of.
