    The Supreme Court has refused to cancel the interim bail granted to businessman-Suryakant Tiwari in the Chhattisgarh Coal Levy 'Scam' case.     The Supreme Court has refused to cancel the interim bail granted to businessman-Suryakant Tiwari in the Chhattisgarh Coal Levy 'Scam' case. It has further granted interim bail to the businessman in the DMF scam case on the same terms and conditions imposed earlier in May.

    A bench of Justices Surya Kant and Joymalya Bagchi granted the relief, after having heard substantial arguments yesterday. In taking the view, it noted that a condition has been imposed on Tiwari vide the May order as per which he shall not stay in the State of Chhattisgarh except when required by investigating agencies/trial courts.

    The Court was in seisin of two cases - one, filed by Tiwari seeking interim bail in the DMF 'scam' case, and second, filed by him in relation to the Coal Levy 'Scam' case, where State of Chhattisgarh had filed an application seeking cancellation of bail granted to him.

    The order, uploaded today, reads:

    "we are of the opinion that in the instant case as well, the Petitioner can be released on interim bail, at this stage. In all fairness, we are not referring to the submissions made by both sides, as such a holistic consideration is better deferred to the stage of final hearing."

    The Court has clarified that Tiwari shall remain bound by the conditions imposed by in the earlier interim bail order dated 29.05.2025. On the prayer to cancel Tiwari's bail in the Coal Levy 'scam' case, it has said,

    "We have duly considered the grounds urged for recalling our order dated 29.05.2025 granting interim bail to the Petitioner, namely Suryakant Tiwari. However, we find no cogent reason for entertaining the present application at this stage, and the same is accordingly dismissed."

    At the same time, the Court has reserved liberty for the prosecution to seek cancellation of Tiwari's interim bail if any material about misuse of concession emerges.
