    The Supreme Court will hear today a bunch of petitions challenging the Election Commission's "Special Intensive Revision" of Electoral Rolls in Bihar.

    A bench of Justices Sudhanshu Dhulia and Joymalya Bagchi will hear the matters.

    Petitions have been filed by the MPs Mahua Moitra (Trinamool Congress), Manoj Kumar Jha (Rashtriya Janata Dal),  leaders of major opposition parties - KC Venugopal (Indian National Congress), Supriya Sule (Nationalist Congress Party - SP), D Raja (Communist Part of India), Harinder Malik (Samajwadi Party. Arvind Sawant( Shiv Sena UBT), Sarfraz Ahmed (Jharkhand Mukti Morcha), Dipankar Bhattacharya ( Communist Party of India (Marxist-Leninist) Liberation), Dravida Munnetra Kazhagam etc.

    NGOs Association for Democratic Reforms, People's Union for Civil Liberties, and activist Yogendra Yadav are the other petitioners.

    Alongside these petitions, a PIL seeking revision of voter rolls before every elections is also listed before the bench.

      J Bagchi: so if someone message filling the form? So there is a condition that even apart from the previous electoral roll the form also needs to be filled. What we are trying to understand is the exercise can inadvertently also and due to circumstances beyond control of an elector create a situation of omission. Such omission can be corrected

      Dwivedi: Not possible.

      J Dhulia: suppose I am a voter. My name was there in the electoral roll in 2025. So my name will be there in the draft?

      Dwivedi: yes. There will be prefilled form that we are going door to door to get filled.

      Bench: even inadvertently no one can be missed?

      Dwivedi: Aadhar is not proof of citizenship or domicile. Once all the application forms have come then the stage of objection and claims will begin. If someone objects that this person is not who he claims to be then Aadhar can be used.

      J Bagchi: that stage will happen only after draft electoral roll. But even in draft electoral roll there is a possibility that some persons name will not be included

      Dwivedi: Aadhaar can be issued even to non citizens that are resident of India. Every resident is entitled. See the Aadhar Act. Aadhar number by itself I will not create any proof of citizenship. If there is an objection with respect to my form that you are not Rakesh Dwivedi then I can take out my Aadhar and show

      J Dhulia: caste certificate is based on Aadhar. Caste certificate is there on the list but Aadhar is not.

      Dwivedi: caste certificate is not based only Aadhaar.

      J Dhulia: a document that is the basis of so many other documents you are not allowing.

      Dwivedi: more than 60% forms have been filed. That is around 5 crores. Now for the first time we have created a system ECI net where all the documents will be uploaded so that this may not be repeated again.

      Dwivedi: Which constituency I am listed as a voter will be that where I am ordinarily resident. Each document that is listed in the non-exhaustive list has a purpose.

      J Dhulia: So Aadhaar can be used?

      Dwivedi: It is not a proof of certain things. It is only approve of identity.

      Each document has a purpose and for that purpose it is usable.

      Dwivedi: all the procedure will be followed all principles of natural justice will be followed.

      J Dhulia: so you will give them a hearing?

      Dwivedi: of course. What they are saying is something else. They are saying that if a person does not give a form then there will be no form and then there will be no hearing. I will answer that too.

      Dwivedi: nobody can have a quarrel that why you are purifying the electoral roll.

      J Bagchi: that's why the question is why you are making this exercise relatable to an election coming in November. If it is an exercise that can be independent of the election for the whole of the country.
