The Supreme Court today(June 11) refused to quash a case under the POCSO Act against a suspended judicial officer, who has been accused of sexually abusing his daughter. The Court orally passed serious remarks stating that this is a "shocking" case which is certainly not meant for quashing by any standard.
A bench of Justice Prashant Kumar Mishra and Justice Manmohan was hearing a special leave petition filed against the April 15 Bombay High Court's order refusing to quash allegations against the accused. At the outset when the Counsel for the accused stated that the man's life is already ruined as his father committed suicide and that he is also involved in a matrimonial dispute, Justice Manmohan orally remarked that the Court does not want to get into this aspect but added "this(father's suicide) would have been due to son's action rather than anyone else's action".
Justice Manmohan objected to the plea of quashing and orally commented that this is a "shocking case, this is a judicial officer, serious allegations of incest! Madam, this is not the case to be entertained for quashing by any standard. I don't know what legal advice you are getting, but this is not a case certainty by any standard. You daughter is making the allegations, no? She must have been scarred to life."
Justice Mishra also concurred and added that this is certainly not a case for quashing.
When the Court refused to entertain it, the counsel requested for the expedition of trial which the Court allowed.
