      Sr Adv Shoeb Alam (for an MLA): Spirit of the Act is 'inclusion' - to bring in fold as many people as possible. Disqualification grounds require a high threshold. There are people with no documents - you can't make the process exclusionary. Absence of any reasons in the notification will show that why process of summary and intensive revision has been substituted by SIR...no receipt given on submission of enumeration forms. We have to show domicile certificates...we have made applications, they are not being processed as authorities are overwhelmed...all those people don't have documents...deadline coming to an end...I am left high and dry.

      Pasha mentions an application seeking information from ECI

      J Bagchi: you would like ECI to enlighten this court as to what were the documents called up in 2003 intensive exercise

      Pasha: Yes. Despite submitting form, people are not being included. I have attached affidavits of people. Presumption of constitutionality and citizenship in Lal Babu Hussein case applies.

      J Kant: Are you associated with any political party?

      Pasha: I'm state president

      J Kant: Then you must be aware whether BLO has given...

      Pasha: Just from one booth, there have been 231 deletions...who were part of 2003 rolls...BLOs exercising their own discretion. I may file a claim, but those who are in the list, does the list mention what documents they have submitted? At stage of verification, they may not be able to show what documents were submitted/not-submitted.

      Pasha: Basis of the [ECI] notice seeking to create different classes not correct. Youth of the state are being made to jump through hoops...

      J Bagchi: There may be cases where name does not appear in 2003 rolls, but appears later...would you say it is a clog on the...

      Pasha: By asking for documents, bar is sought to be raised for the youth of the state. It's a deeply suspicious fact. Anti-incumbent vote dilution intended...today 65 lakhs may have been left out, but once examination of forms is done, it will be seen that youth is impacted. Once form is being submitted to BLO, no receipt being given to elector.

      Hearing begins

      Adv Nizam Pasha (for petitioners): Entire process for inclusion of any individual is the same, whether intensive or summary revision. If he's holding EPIC card, issued as of 2025, he has been through the same process. Selection of 01.01.2003 casts suspicion on ECI's own actions...no basis for this selection. No constitutionally valid explanation.
