    The Supreme Court today issued notice on an application seeking the take-down of an AI-generated video posted on 'X' by Bhartiya Janata Party's Assam unit which statedly showed apprehension of a takeover of the state by Muslims if the party loses elections.

    A bench of Justices Vikram Nath and Sandeep Mehta passed the order after hearing Advocate Nizam Pasha (for applicants), who argued:

    "A video has just been posted as part of upcoming election...it shows that in case a certain political party does not come to power, a certain community will take over...it shows people with skullcaps and beards...[as per Court's directions] FIR should be suo motu lodged...if FIR is not lodged, contempt action is to be undertaken."

    The matter has been listed on October 28.

    The application has been filed by journalist Qurban Ali and Senior Advocate Anjana Prakash in a PIL seeking action against hate speeches/hate crimes across the country. This is the matter where all States/UTs were directed to suo motu register FIRs against hate speeches, without waiting for any formal complaint. As per the Court, the action ought to be taken regardless of the religion of the speaker and any hesitation to act as per the directions is liable to be viewed as contempt of Court.

    The application states that the subject video was posted by BJP's Assam unit on 'X' on 15.09.2025. It shows a "grossly false narrative" that Assam would be taken over by Muslims if BJP does not remain in power in the state. "The video...shows visibly Muslim people (wearing skullcaps and burqas) taking over tea estates, Guwahati airport, Guwahati Accolad, Assam Ranghar, Guwahati Stadium, Rang Ghar, Guwahati town. The video further shows illegal migrants who are visibly Muslim coming into Assam; Muslims acquiring government land; and finally, that the State has 90% Muslim population."

    The applicants aver that BJP-Assam is bound to uphold secular values of the Constitution, but the video circulated from its official handle "openly targets, vilifies and demonizes Muslims". "The broad message of the video is that the worst fate that a State can be met with is its takeover by Muslims, and on the strength of the assurance that if the BJP is voted into power the State would be saved from the same, support is being sought", the application states.

    The applicants pray for take-down of the video in order to prevent communal disharmony, unrest and enmity.

    The application was filed through AoR Lzafeer Ahmad. Advocate Pasha was assisted by Advocate Rashmi Singh.
